Avoiding U.S. anti-dumping duties
On July 28, 2023, the United States filed an anti-dumping duty (AD) application against mattresses from 12 different countries and a countervailing duty application against mattresses from Indonesia. In order to impose anti-dumping/countervailing duties, the US government must not only determine whether dumping and/or subsidies are occurring, but also whether there is "substantial harm" (or its threat) to the dumped and/or subsidized imported products.
The US anti-dumping law imposes special tariffs to offset imported products sold in the US at prices below "normal value.". The US Anti Subsidy Act imposes special tariffs to offset imported products sold in the United States and subject to foreign government subsidies. In order to impose anti-dumping/countervailing duties, the US government must not only determine whether dumping and/or subsidies are occurring, but also whether there is "substantial harm" (or its threat) to the dumped and/or subsidized imported products. Importers are responsible for paying any potential anti-dumping/countervailing duties
